While in Paris, Grotius

published his legal masterpiece,

De

Jure Belli ac Pacis (On the Law of War and Peace)

, in 1625. In writing

this

work he was strongly influenced by the bitter, violent political struggles both

in his own country and in Europe more broadly, particularly the

Thirty Years’ War

,

which had broken out in 1618. Grotius sought to achieve his practical objective

to minimize bloodshed in wars by constructing a general theory of

law (jurisprudentia

) that would restrain and

regulate war between various independent powers, including states. Grotius’s masterpiece has been

most influential in the area of international law. Its general normative

framework provided a foundation to

constitute and regulate relations between emerging sovereign

states, which became the basic units of modern international

society.

Why is the work of Hugo Grotius considered to be a legal masterpiece?

 Some of the Hague Conventions

deal with the determination of the applicable law, while others deal with the

conflict of jurisdictions, with the recognition and enforcement of foreign

judgments or with administrative and judicial cooperation between authorities,

or a combination of one or more of these aspects of Private International Law.

The structure that is witnessed in the traditional analysis of Private International

Law, where problems are divided into classification categories, is also very

much present in the achievements of the Hague Conference. Conventions of the

Hague Conference on applicable law typically deal with a specific category.

The analysis of Private International Law is

characterized by a structured approach. Although national Private International

Law systems differ, the main elements of this approach have found acceptance in

many jurisdictions. On the other hand, the doctrine of Private International

Law is still occupied with questions as what is the proper basis for a rule on

Private International Law. An example is the principle that should be at the

heart of a choice of law rule, should it designate the law that is closest

connected to the case, should it protect certain interests or should it direct

to the

lex fori?

International human rights law lays

down obligations which States are bound to respect. By becoming parties to

international treaties, States assume obligations and duties under

international law to respect, to protect and to fulfil human rights. The

obligation to respect means that States must refrain from interfering with or

curtailing the enjoyment of human rights. The obligation to protect requires States

to protect individuals and groups against human rights abuses. The obligation

to fulfil means that States must take positive action to facilitate the

enjoyment of basic human rights.

International

intellectual property law refers to a set of laws that govern the creation,

protection, sharing, and use of intellectual property (IP) in the global

context.

IP is intangible

property created through mental work, such as an invention, creative work,

design, or idea. Since it is non-physical, IP can be easily used or implemented

in multiple countries. It is common for IP issues to arise because

IP laws

can vary significantly from one country to

another. However, there are organisations that seek to provide global IP

protection by establishing international IP laws.
