It is the year 250 BC. Marcus is a Roman farmer and is known

for his prize-winning herd of cattle. Three years ago, one of his cows gave

birth to a bull calf. However, the calf was very weak at birth, and nobody

expected it to survive long. An expert told Marcus at the time that the calf

had no monetary value and that he would only be throwing good money after bad

money if he spent any funds on raising it. Nevertheless, Marcus loves all his

animals, and he decides to do his best for the calf. He gives the calf

medicine, feeds it special food, and even lets the calf sleep inside his house

during the cold winter months. Remarkably, the calf not only survives, but

grows strong, and becomes one of Marcus’ favourite animals. He enters the bull

into a competition, and it wins first prize. Suddenly, the bull is the talk of

the town, and the other farmers start to take notice of it. They offer Marcus

large sums of money to buy the bull for their own herds. Atticus offers Marcus

ten gold coins. Augustus hears of the offer, and visits Marcus the next day,

offering him twenty gold coins for the bull. Marcus is seriously considering

Augustus’ offer, but the local wise woman, who is believed to have the gift of

foreseeing the future, advises Marcus that the bull is seriously ill, that it

suffers from a heart defect, and that it is probably not worth more than two

silver pennies. She says the bull will not survive another winter. After giving

it much thought, Marcus declines both offers from Atticus and Augustus. However,

Atticus is very disappointed and decides that if he cannot have the bull,

nobody will have it. He sneaks into the barn where the bull is kept at night,

and beats the bull to death with a stick. When Marcus finds out, he is

distraught over the loss of his favourite animal. He decides to institute a

claim against Atticus for delictual damages in terms of the

Lex Aquilia.
