High Court Rules contain provisions designed to enforce

compliance and condone noncompliance with the rules of court.

The

period within which the applicant must act commences as soon as a party takes

notice that a step has been taken or that a proceeding has occurred, and once

the irregularity thereof has come to his notice.

The onus of proof is relevant in that it the

provisional sentence case itself in the principal action.

Steps

which may be taken only before the close of pleadings is to request for further

particulars for trial, a pre-trial conference and discovery

of documents and tape recordings.
