Local government representatives can

attend NCOP meetings.

All the provinces have an equal

number of members in the NCOP, irrespective of the provinces’ population size.

A member of a province’s permanent

delegates can be recalled when the provincial legislature has lost confidence

in the person.

Cabinet members can attend NCOP

meetings and can vote there.

The central authority does devolve

exclusive powers to the regions.

The Constitution provides

for both exclusive and concurrent powers.

It is a predominantly decentralised, federal form (such as the

provinces) but with centralised, unitary features.

Provincial legislation can

precede over national legislation in the case of concurrent powers.

The

members of the Executive Council are individually and collectively accountable

to the provincial legislature.

The

Premier’s term is limited to two terms of five years each.

An

acting Premier can be in office for a maximum of 30 days after which a new

Premier must be elected.

The

Premier cannot be removed from office by a motion of no confidence but can only

resign.

Registration

of voters is the responsibility of political parties.

It

should consist of at least five members, appointed by the President on advice

of Parliament, for a period of five years.

The

Electoral Court (on the advice of the IEC) should declare an election as free

and fair.

The

IEC is responsible to manage all national, provincial and local government

elections.
