The person who has committed the delict (the minor) must compensate the other party (the major) for the damage suffered as a result of the delict.

A fraudulent minor commits a delict, which is a wrongful culpable act which causes damage to another, and should therefore be delictually liable.

Delictual liability does not allow the minor to extend his or her capacity to act by means of misrepresentation.

There is always an obligation on the other party (the major) to enquire into the truth of the minor’s statement regarding his or her capacity to act.
