PART I: Public Financial System, Public Financial Resources and Public Revenue

Practical Case: The Municipal “Urban Sustainability Contribution”

The municipal council of a large Lithuanian municipality decides that additional financial resources are needed to improve public transport, waste management and local environmental infrastructure.

The municipality already receives several different types of financial resources.

First, part of the personal income tax revenue collected under national legislation is allocated to the municipal budget.

Second, the municipality receives a State-budget grant intended specifically for the performance of a State function delegated to municipalities.

Third, it receives European Union financial support for a sustainable urban transport project.

Fourth, the municipality owns a multi-storey parking facility. Users who choose to park there pay an hourly parking charge determined by the municipality.

Fifth, under the applicable municipal rules, property owners are required to pay a local municipal waste-management fee.

Sixth, one local company has recently been ordered to pay EUR 8,000 after violating legally binding environmental requirements.

The municipal council nevertheless considers these resources insufficient. It therefore adopts a new decision establishing an “Urban Sustainability Contribution”.

According to the municipal decision:

  • every legal person registered within the municipality must pay EUR 300 each year;

  • companies owning more than twenty vehicles must additionally pay EUR 40 for every vehicle exceeding that number;

  • payment is compulsory regardless of whether the company uses municipal public transport, waste-management infrastructure or any other specific municipal service;

  • all revenue will be used to improve public transport, bicycle infrastructure and other environmental projects;

  • the money must be transferred directly to a special account controlled by the municipal environmental department;

  • the municipal decision describes the payment as a “local environmental fee”.

The municipal council explains that municipalities enjoy financial autonomy and must be capable of financing local functions. It also argues that the payment cannot be regarded as a tax because all the money will remain within the municipality and will be spent exclusively for environmental purposes.

A company called Baltic Logistics UAB refuses to pay the contribution.

The company argues that the municipality has effectively created a new local tax without sufficient statutory authority. It also argues that the payment cannot genuinely be regarded as a fee because the company receives no specific individual service in return.

The municipality responds that the legal name of the payment is “fee”, that environmental protection serves the public interest and that local self-government would be ineffective if municipalities could not develop new sources of revenue when existing resources are insufficient.

Questions

1. Analyse the legal nature of the “Urban Sustainability Contribution”.

Determine whether, on the facts provided, the payment has the characteristics of a tax, a local fee, another compulsory public-law payment or an unlawfully created financial obligation.

In your analysis, consider:

  • the compulsory character of the payment;

  • the event or status triggering liability;

  • whether an individualised public service is provided in return;

  • the purpose and destination of the collected money;

  • the significance, if any, of the municipality calling the payment a “fee”.

Reach a reasoned conclusion rather than relying on the formal title of the payment.

2. Assess whether the municipality has legal competence to establish the contribution.

Analyse the relationship between:

  • municipal financial autonomy;

  • the municipality’s constitutional right to have its own budget;

  • statutory authority to impose compulsory public-law payments;

  • the principle that financial necessity and a legitimate public purpose do not by themselves create legal competence.

Would your conclusion change merely because all revenue is intended to finance environmental and transport projects?

3. Classify the other financial resources appearing in the case.

Compare the legal character of:

  • the municipality’s share of personal income tax;

  • the targeted State-budget grant;

  • European Union financial support;

  • revenue from the municipal parking facility;

  • the municipal waste-management fee;

  • the EUR 8,000 payment resulting from the environmental violation.

Explain why these financial inflows should not all be classified as the same type of public revenue merely because they ultimately provide resources to a public authority.

4. Assess the decision to transfer the Urban Sustainability Contribution directly to a special account controlled by the municipal environmental department.

Would the municipality be entitled to keep compulsory public revenue outside the ordinary legally recognised public-finance structures simply because the resources are earmarked for a specific public purpose?

Explain the relevance of the legal organisation of the Lithuanian public financial system and the distinction between:

a legally established public fund or budgetary resource

and

a bank account created administratively by a public institution.

5. Apply the complete legal-reasoning method to Baltic Logistics UAB’s refusal to pay the contribution:

FACTS → LEGAL ISSUE → APPLICABLE LEGAL RULE / PRINCIPLE → APPLICATION → REASONED CONCLUSION.

Your analysis should identify:

  • the relevant public financial relationship;

  • the competent public authority;

  • the source from which the municipality would need to derive its financial competence;

  • the legal characteristics of the payment;

  • the principal arguments available to both the municipality and the company.

6. Change one fact.

Assume that the Seimas subsequently adopts legislation expressly authorising municipal councils to establish an urban sustainability fee within a defined range, specifies the persons who may be liable, identifies the permitted purposes of the revenue and allows municipalities to determine the precise amount by municipal decision.

Would the municipal payment now automatically be lawful?

Explain which legal questions would still have to be examined before reaching a final conclusion.
